Statute text It is unlawful for any person to allow a dog belonging to or under the control of such person, or that may be habitually found on premises occupied by the person, or immediately under the control of such person, to go upon the premises of another, or upon a highway or upon a public road or street; provided, that this section and § 44-8-409 shall not apply to a dog on a hunt or chase, or on the way to or from a hunt or chase, nor to a dog guarding or driving stock, or on the way for that purpose, nor to a dog being moved from one (1) place to another, by a person owning or controlling a dog; provided, however, that the foregoing exemptions shall not apply unless all damages done by dogs therein exempted, to to damaged, or to the person's agent, within thirty (30) days after the damage is done. e) It is not a defense to prosecution for a violation of subsection (b) and punished pursuant to subdivision (g)(1), (g)(2) or (g)(3) that the dog owner exercised reasonable care in attempting to confine or control the dog. (f) It is an affirmative defense to prosecution for a violation of subsection (b) and punished pursuant to subdivision (g)(4) or (g)(5) that the dog owner exercised reasonable care in attempting to confine or control the dog. (g)(1) A violation of this section is a Class C misdemeanor punishable by fine only ($50). (2) A violation of this section is a Class B misdemeanor punishable by fine only ($500) if the dog running at large causes damage to the property of another. (3) A violation of this section is a Class A misdemeanor punishable by fine only ($2500) if the dog running at large causes bodily injury, as defined by § 39-11-106, to another. (b) A person is justified in killing the animal of another if such person acted under a reasonable belief that the animal was creating an imminent danger of death or serious bodily injury to such person or another or an imminent danger of death to an animal owned by such person. In the case of overly friendly dogs, is is NOT RECOMMENDED to do ANYTHING to encourage such behaviour. Friendly dogs have been known to follow riders for miles, endangering the riders and the dog who does NOT belong in the road and can be killed by motorist, attacked by other dogs when entering their territory, or simply lost. Doing what you can to discourage following bikers just may save his life and injuries to yourself or other riders. =================================================================
What Dogs to Watch Out For?
Any dog, friendly or not, can cause a serious accident.
The US Center For Disease Control has compiled the following:
4.7 million people are bitten by a dog each year.
Of those, 386,000 require medical attention.
(note- this does not include wrecks/injuries caused by loose dogs that didn't bite)
Between 1979 and 1996 one-third of the 300 dog attacks in the US were from Pit Bulls.
Between 1993 and 1996 over one-half of the fatal dog encounters were from Rottweilers.
Other high incident breeds: German Shepherd, Husky, Malamute, Doberman, Chow Chow,
Great Dane and Saint Bernard.

Over the last 20 years, 32% of deaths from dog bites were from pit bulls. Today two-thirds of deaths are from Pit Bulls, yet they account for only 5% of all dogs.
